ACLU SUES LA COUNTY for (teeny) Cross in County Seal -- Supervisors CAPITULATE
local news, Dennis Prager Talk Radio ^ | June 2, 2004 | self

Posted on 06/02/2004 3:23:38 PM PDT by bboop

ACLU has just sued Los Angeles County for having a cross on their County Seal. The cross represents the San Gabriel Mission (estab'd 1771) around which the city grew. We LOVE our Missions, and we cherish our history. How DARE the ACLU try to erase it?? Dennis Prager featured it this am, interviewed Supervisor Mike Antonovich, who is one (of 2)(out of 5) who want to fight this. The vote is not til next Tuesday, June 8. I called Sup. Don Knabe's office, and she said "Would you fax a letter of support?" I encourage everyone from all over the country to contact these five Supervisors. Now this is happening in LA County, but 'coming soon to a city near you.' Sup. Zev Yaroslavsky/ 213.625.7360 fx; Sup. Gloria Molina, 213.613.1739 fx; Sup. Yvonne B. Burke, 213.680.3283 fx; Sup. Michael Antonovich, 213.625.7360 fx (against capitulating); Sup. Don Knabe 213.626.6941 fx (against capitulating). dennisprager@dennisprager.com also wants to hear from all who are upset. Time to stop the ACLU.

Yeah, this sucks. The only solution I can think of is for the citizens of LA county to sue the county for failure to protect their Constitutional rights.

People today are more concerned than ever about the joining of religion and state... no matter how benign or beneficial the religion is. Islamofascism has forever concretized the "wall of separation" that most Christians disdain so deeply.

To see the Seal of the County of Los Angeles and a written discription:

http://www.lacounty.info/seal.htm

To contact the Supervisors:
The Cowardly who gave into the ACLU:
Gloria Molina http://molina.co.la.ca.us/
Yvonne Burke http://burke.co.la.ca.us/
Zev Yaroslavsky http://zev.co.la.ca.us/default.htm

THANK the FIGHTERS for FREEDOM:
Don Knabe http://knabe.com/
Mike Antonovich http://antonovich.co.la.ca.us/

We need people of all faiths and of no faith to respond to ALL supervisors. I called the American Center For Law and Justice http://www.aclj.org/ today. They are looking into the case.

I don't want my tax dollars wasted to change the seal. I'd rather it be spent to FIGHT!! The change will be costly. A fellow worker that attaches seals and signs for the County told me that it costs $64 per seal that is put on a vehicle. There are at least 2 seals per vehicle for a total of $128 per vehicle. I work in a department that has nearly 1000 vehicles....$128,000. That is just one department! ID Badges are replaced at a cost of $5 per badge (that does not include specialty access badges. So for 90,000 employees that is $450,000. Flags at every County building, wooden seals in each court room, seals on the doors, plaques, proclamations, stationery, and many other objects that have the seal would have to be replaced within the County's 4,084 square miles with 88 cities and more than 140 unincorporated communities.

I can't believe that the 10,047,300 people of the largest County in the United States will cower to those in the ACLU. We must fight to keep our history!

We need everyone....from all over the country to express their opinion! If we let the LARGEST COUNTY fall...all will fall....Email the Supervisors. Let Molina, Burke, Yaroslavsky know that they are not "admired" by the rest of the USA for being cowards!

What I find funny is that the ACLU is so selective on this issue. The seal of LA county actually contains TWO religious symbols:

The cross is on the right, of course, but the central figure in the seal is the Roman goddess Pomona, originally one of the Roman goddesses of harvest and orchards, but who later became associated with the pagan holiday of Samhain after the Romans invaded northern Europe. The influence of Pomona on Samhain led to the creation of many well known witchcraft and divination spells that are still practiced by Wiccans today.

So why doesn't the ACLU demand her removal as well??? Hmmmm???

Good point! Maybe those of us offended that the cross will be removed should demand Pomona be removed. Then maybe they would see how absurd removal is? Ha! Who am I fooling?

The only place the ACLU likes the use of the Cross is in The Exorcist.

Any possibility that this was a "friendly" law suit? In other words, the fix was in and the Supervisors wanted political cover for a decision they had already made?

Possibility? It's the first thing that came to my mind when I heard of the capitulation. What government body allows itself to be pushed around by private groups with a grudge?

I wonder... are there any lawyers around who could give an opinion as to whether the ACLU's behavior would qualify for a RICO suit?

Addendum to this... maybe try a RICO charge under 18 USC 1962(c)? How ironic would it be to turn the "interstate commerce" clause against the socialists? As to pointing out the extortion part, it could be argued that the ACLU extorts via intimidation, through the threat to file frivolous lawsuits for the purpose of imposing financial penalties on entities who do not adhere to their anti-religious ideology in defiance of the protection of religious expression under the First Amendment.

18 USC 1962 (c):
It shall be unlawful for any person employed by or associated with any enterprise engaged in, or the activities of which affect, interstate or foreign commerce, to conduct or participate, directly or indirectly, in the conduct of such enterprise's affairs through a pattern of racketeering activity or collection of unlawful debt.

If you accept that 18 USC 1962(c) applies to the above-referenced ACLU behavior, then the rest of the RICO law applies so solidly that it seems written for this very purpose. All one would do is need to show that the ACLU behavior qualifies as extortion under the Hobbs Act.

The pertinent clause of the Hobbs Act:
"The term 'extortion' means the obtaining of property from another, with his consent, induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right."

If there's an enterprising lawyer out there who can get together enough people/institutions who have been intimidated by the ACLU in this manner, perhaps there's a class-action that can be done.

The kicker is that IF the RICO suit fails, then it is established that it would be legal to set up an anti-ACLU for the purpose of suing the ACLU itself into bankruptcy over every possible breach of law. I'd donate to it ;)

The Los Angeles County Supervisors are gutless spineless capitulators.

They run from law suits as a way of life. In the past, they hired expensive
ineffective lawyers that conspicuously lost suit after suit. Losses in county
fund’s (taxes) were enormous. So now days, they rail in chambers like
tough guys for an hour or two (for the local press), and then give in quickly
to minimize the impact of inevitable court losses.

There isn’t an ounce of principled fight in the full chamber.

They will probably agree to something cheap. Like putting a sticker of a
poppy on the top of Cross so as to use the bottom as a stem.

I'd love to get an organization together, round up about 250,000 members who would all be willing to mail $5 to each and every victim of the ACLU.

Most of these places getting hammered for this frivilous trash just don't have the money to fight them, and find it easier to change whatever symbol the ACLU is griping about.

However, everytime a cross is taken down, a commandment is stricken, and a prayer is silence, a little piece of America crumbles.

If someone started this organization, and issued an ACLU Alert everytime this crap comes up, and at $5 a person the "victim" suddenly have over a $1 million dollars in legal fees, maybe we could slow some of this crap down.

Just a thought..............

And I suppose, like in so many other cities, it is impossible to vote them out?
